Summary: Can an employer fire you if you file for workers compensation?
Gary Burger is the principle and founder of Burger Law's personal injury law firm, and has had a distinguished career defending the rights of the injured and vulnerable. Below is a recent transcript of Gary talking about whether or not you can be filed for filing for workers' compensation.
If you get hurt in a job, can my employer terminate me? If I file a work comp claim? No, it's against the law to do that. They cannot retaliate against workers' compensation claims. Those are employment claims. We handle those from time to time. When that happens to our clients, our workers' compensation lawyers can file additional claims against the employer.
They can fire you, but it is against the law, and the state of Missouri can come and investigate those claims as well.
