QUESTIONNAIRE
Getting clients has been the easiest thing about my law practice. Becoming a excellent attorney took a lot of work and is a never ending process. In the beginning, I advertised heavily and I took cases at very low rates to gain experience. I also got on local referral lists and government panels that are available in the local legal community. I had a very full caseload within just a few months of being licensed as an attorney. And that hasn't changed since. I started out very aggressive. I spent many long nights studying the law and practice guides to teach me the practical things that are not taught in law school. I would go to court and sit an watch trials in my spare time. I had hundred of cases under my belt in a very short amount of time. And I was never afraid to take a case to trial and let a judge or a jury decide. Within a very short time, I gained a lot of trial experience in family law and criminal cases. Within a few years, I had more trial experience (primarily through family law cases) than some attorneys practicing 3 or 4 times as long as me. After a couple years of obtaining solid outcomes for my clients through settlement and trial, word spread. Client referrals, referrals from courtroom staff, domestic violence victims' advocates, and surprisingly referrals from other attorneys, started pouring in. Today, many if not most of my clients come from referrals from previous clients and other attorneys in the community.
What should clients look for in a lawyer?Clients should make sure their potential attorney has experience in the particular area of law that is at issue in their case. However, at a certain point the marginal value of experience plateaus and the underlying natural ability of the attorney becomes the driving factor. Some good attorneys with many years of experience have simply lost their passion. They are just there and go through the motions. Some attorneys are better at settling cases, and some are better at trying cases at trial. I think potential clients should look for natural ability in their lawyer and actually go watch their potential attorney in action in court. See if they have or still have the fire burning inside them to be an aggressive advocate for their clients. It's important to see how other lawyers and judges interact with the attorney. Watch to see the level of confidence the attorney has in court and the level of respect their colleagues have for them. Some attorneys are unprepared, passive, reactive, and are bulldogged by the opposing side. You'll know who those attorneys are by watching them in court just one time. You don't want to hire an unprepared, reactive, or passive attorney. Go watch an attorney in action before deciding to hire them. The day you spend at the courthouse will be worth it.
How important is local knowledge to the success of your cases?Depending on the area of law, it is vital. For family cases, knowing the local judges is of the utmost important. Often the outcome of a contested family law trial has more to do with the judges judicial perspective than the facts of the case. It's a sad but true reality of family law litigation. As far as criminal law, judges matter too. Some judges are more likely to side with the prosecution than the defense on close issues.
What information do you need in a free phone consultation?During any consultation, I need straight to the point and very concise statements about the facts of their case and the present situation. Much of a consultation is spent getting potential clients to stop giving irrelevant information and re-focusing them on the relevant information that I need. Potential clients should try to deliver as much relevant information as possible during a consultation using the fewest words possible.
What differentiates you from other lawyers in your community?I have a wider understanding of the law than most attorneys that I know. Many attorneys only practice in one area of law. For instance, many criminal defense attorneys have no idea how to handle a civil or family law case and could not do so competently. The rules of procedure and discovery are totally different for criminal and civil cases. Likewise, most civil attorneys couldn't handle a simple misdemeanor criminal court case competently. As someone that practices both criminal and civil law, I have a broad understanding of the practice of law. As someone that practices both criminal and family law, I am in court virtually everyday. Most other personal injury attorneys rarely go to court and do most of their work outside of court. As an attorney that practices both family and criminal law, in addition to personal injury, I have a lot more courtroom experience than lawyers in my community that strictly practice personal injury litigation.
What is the most rewarding aspect of your job?The most rewarding part of my job is getting my client justice. Justice can mean different things for different types of cases. But what most people don't realize is that getting justice is not free and it is not automatic. If it were, we wouldn't need lawyers. Knowing that I was the primary reason why my client obtained justice in a particular case is a very rewarding feeling.
What are your other interests in addition to law?In addition to law, I'm interested in politics and freedom. I strongly believe in civil liberty.
Are you involved in your community?I consider myself to be involved with my community. I take part in community discussions online a lot through social media. I try to maintain good relationships with the local community and continuously try to make new relationships. Having relationships with people in the community is a very important part of maintaining a successful law practice.

Cases
Case: J.I. v. L.A Summary: Mother sought to relocate with Child from Bay Area to Chicago. Father was represented by counsel and opposed. Mr. Tabayoyon represented Mother at trial. After a two day court trial, Mother prevailed and her request to move away with Child was granted. Result: Move away request granted after trial. Case: People v. B.N. Summary: B.N. was charged with soliciting for acts of prostitution. After negotiations with the D.A.'s office, the case was dismissed after B.N. completed 25 hours of group and individual counseling. Result: Case Dismissed. Case: People v. M. C. Summary: M.C. was charged with DUI and DUI causing injuries. A jury trial resulted in a hung jury. Thereafter, the District Attorney's Office offered M.C. to plead to simple drunk in public and he accepted rather than retry the case. Result: Hung Jury on DUI; Plead to Simple Public Intoxication. Case: People v. J.S. Summary: Client was charged with DUI after being pulled over for swerving within his lane and once touching the dividing line. Police followed him for only 30 seconds over a short distance prior to pulling him over. Mr. Tabayoyon filed a motion to suppress the evidence and arrest due to the traffic stop being in violation of the 4th and 14th Amendments to the United States Constitution. The court granted the motion and the District Attorney's Office had little choice but to dismiss the case. Result: Motion to Suppress Granted. Case Dismissed. Case: T.T 's vs. AIG Summary: T.T. was in a minor rear end auto accident. Mr. Tabayoyon obtained a $20,000 settlement from AIG insurance company. Result: Settled T.T.'s personal injury claim for $20,000. Case: People v. A.R. Summary: A.R. was charged with domestic violence. After Mr. Tabayoyon conducted investigation he convinced the District Attorney's Office they had a weak case. A.R attended a 16 hour anger management diversion program (two Saturdays) and kept his nose clean for six months. Then the District Attorney's office dismissed the case without A.R. ever pleading guilty or no contest to anything. Result: Case Dismissed. Case: People v. R.C. Summary: R.C. was charged with domestic violence. His wife falsely accused him of DV to obtain child custody. The district attorney's office offered him a great deal and he refused to accept it because he was innocent. Mr. Tabayoyon represented R.C. at his jury trial and obtained a unanimous (12-0) not guilty verdict for him. Result: Not Guilty Jury Verdict Case: Guardianship of N.T. Summary: Mother hired Mr. Tabayoyon to terminate a guardianship over her minor child N.T. The guardian was the maternal grandmother. Maternal Grandmother had tricked Mother into giving her a guardianship under the false pretense of obtaining health insurance for N.T. through Maternal Grandmother's employer. Eventually, Maternal Grandmother completely denied Mother visitation with N.T. using the guardianship. First, Mr. Tabayoyon obtained a termination of the guardianship for Mother after a contested trial on the Petition to Terminate Guardianship. Second, Mr. Tabayoyon successfully argued post trial against a post guardianship visitation schedule with Maternal Grandmother based on Constitutional grounds. Result: Guardianship Terminated. Fixed Grandparent Visitation Denied. Case: People v. L.P Summary: L.P was charged with domestic violence. The initial offer wasn't good enough so Mr. Tabayoyon set the case for trial. The DA then had a change of heart and offered L.P. a division program. After 16 hours of anger management, the criminal domestic violence charges against L.P. were completely dismissed Result: Case Dismissed. Case: People v. G. A. Summary: G.A. was charged with obstructing a police officer. After Mr. Tabayoyon told the DA he was setting the case for trial, the DA offered G.A. to plead to disturbing the peace with loud noise and received 1 year probation. Result: Charge reduced. Case: People v. Q. C. Summary: Q.C. was charged with two counts of felony domestic violence causing injury. After a preliminary hearing, Mr. Tabayoyon persuaded the judge to reduce the charges to misdemeanors. The district attorney filed a motion for reconsideration of the reduction from felonies to misdemeanors. Mr. Tabayoyon successfully defended against the motion and it was denied. Q.C.'s now misdemeanor charges were resolved as part of a plea deal in another serious case, and Q.C. avoided additional prison time because Mr. Tabayoyon had his felonies reduced to misdemeanors. Result: Felonies reduced to misdemeanors. Case: People v. B.R.C. Summary: B.R.C. was charged with Felony resisting arrest and misdemeanor battery against a peace officer. Officers broke 5 of his ribs and charged him with the mentioned crimes to cover up their misconduct. Mr. Tabayoyon obtained unanimous jury verdicts of not guilty on all counts for his client. Result: Not Guilty Jury Verdict Case: People v. W. K. Summary: W.K. was charged with domestic violence causing a traumatic condition and child endangerment. Mr. Tabayoyon represented W.K. at his jury trial and the jury found W.K. not guilty of both charged counts and the jury was hung on the less included offense of domestic battery. Result: Not Guilty Jury Verdicts Case: K.K. vs. Nationwide Insurance Summary: K.K. was involved in a minor auto accident. She retained Mr. Tabayoyon who recovered the policy limits of $25,000 from Nationwide Insurance company. Result: $25,000 Policy Limits Recovery Case: R.R. v. Bristol West Summary: R.R. was involved in a minor auto accident. He retained Mr. Tabayoyon and Mr. Tabayoyon obtained a $34,000 settlement from Bristol West Insurance Company. Result: $34,000 Case: R.M. vs. City of Livermore Summary: R.M. had his constitutional rights violated by Livermore Police. Livermore denied Mr. Madrid's claim for damages he made with the City of Livermore. Mr. Tabayoyon filed a federal lawsuit and Livermore agreed to settle the case and pay Mr. Madrid almost immediately. Result: Undisclosed settlement amount.
