Michael Alan Mcmahan, Attorney

Mike was born in Nashville, Tennessee, in 1944. He is married and has one adult daughter who is also an attorney. He has practiced law in Chattanooga since 1973.

He is a board-certified civil trial specialist by the National Board of Trial Advocacy and is certified as a Civil Trial Specialist by the Tennessee Commission on Continuing Legal Education and Specialization.

Mike is a 1968 graduate of the University of Tennessee College of Law. He served in the United State Army, Judge Advocate General's Corp, from 1969 through 1973. His culminating assignment was the Chief of Military Justice for the XVIII Airborne Corp and Fort Bragg where he was responsible for supervising seven attorneys. He served as Adjunct Professor at the University of Tennessee at Chattanooga from 1985 throught 1988.

Mike's litigation practice has ranged from automobile accident claims and divorces to constitutional civil rights claims. In recent years, he has been involved in a number of employment discrimination, American's with Disabilities Act, and sexual harassment suits in federal and state courts.

In addition to his civil litigation practice, Mike maintains a diverse office practice He has a broad range of experience in corporate representation including employment law, environmental law, construction, contracts, and general corporate representation.

Mike represents moderately large and small corporate and business entities. He can assist in forming corporations, partnerships, other limited liability corporations, or other business organizations.

Mike's environmental practice has included representation of clients with regard to federal and state superfund sites. He has been involved in environmental spill litigation. He has been involved in waste disposal issues from landfills to sanitary sewers and the beneficial re-use of landfill gas. He was the primary author of Tennessee's enabling legislation on storm water regulation by local governments.

Mike has been retained as special counsel to the City of Chattanooga since moving to Chattanooga in 1973. Over the years he has been entrusted with some of the City's most inportant litigation and corporate affiars.

Currently he is representing a client involved in the 21st Century Waterfront Plan involving more than $60 million dollars of downtown development along the Tennessee River. This representation has ranged from the formation of the corporation and acting as its general counsel with respect to the issuance of bonds to finance the project through construction contracts and problems. It has involved complex, issues relation to the acquisition of properties, including those with environmental issues and the negotiation of a condominium arrangement on one parcel.

He is admitted to practice in Tennessee state courts, the United States District Court, Eastern District of Tennessee, United States Court of Appeals, Sixth Circuit, and the United States Supreme Court. He is a member of the Chattanooga and Tennessee Bar Associations.

Mike's hobby is bird-watching. He is approaching 500 birds on his North America list and hopes to reach this milestone this year.
