What is Prior Written Notice?

Prior Written Notice (PWN) is one of the procedural safeguards, or legal rights, put in place for parents. PWN is separate from the Individualized Education Program (IEP), and must be done in writing. PWN is used when a student’s Planning and Placement Team (PPT) suggests or denies a change in their eligibility, evaluation, placement, or a FAPE provision. The proposed change cannot be put in place until 10 days after the parent receives the notice, unless the parent and school district agree to implement the change earlier. The Individuals with Disabilities Education Act (IDEA) states that PWN must state:

the proposed or refused action;

why the action is being proposed or refused;

what the basis of the school’s decision was;

the protections and procedural safeguards that children with disabilities and their parents are entitled to and how they can get a copy of them;

resources to help parents;

other options that were rejected and why; and
-
other factors relevant to the decision.
