What is the Purpose of Educational Mediation?

Mediation is a procedure that enables parents and school districts to settle disputes without going to court. Under the Individuals with Disabilities Education Act (IDEA), mediation must be voluntary for both parties, should not deny or delay the parent’s right to a formal hearing, and must be run by a properly trained and impartial mediator. Some of the matters that may be settled through mediation include disagreements on:

whether a student is disabled;

which disability a student has;
-
a student’s evaluation;

a student’s program placement; or
-
other matters related to a student’s special education and access to a Free Appropriate Public Education (FAPE).
