Greater Middleton Association v. Holmes Lumber Co. (1990) 222 Cal.App.3d 980 Practice Area: Appeals Outcome: Enforcement of equitable servitudes to prevent commercial logging in Middleton Tract upheld. Description: This decision upheld the enforcement of "equitable servitudes" to prevent a lumber company from logging in a remote residential area with ancient redwoods. This was one of the first legal decisions concerning equitable servitudes in the last 75 years, and is frequently cited in both California Court decisions and decisions in other states. Ghafur v. Bernstein (2005) 131 Cal.App.4th 1230 Practice Area: Appeals Outcome: Court upheld dismissal of libel suit on ground that plaintiff was a "public official." Description: Libel case brought by Muslim charter school principal falsely accused of terrorist connections. First case to hold that a principal of a private charter school was a "public official" and therefore required to prove malice. People v. Wilson, 50 Ill.2d 323 (Supreme Court of Illinois) Practice Area: Appeals Outcome: Defendants permitted to file late appeal on grounds that they were not advised of their right to appeal Description: Affirmed right of persons convicted of misdemeanors to be advised of right to appeal conviction. Illinois Supreme Court held intermediate appellate court abused its discretion in refusing to permit late appeal.
