introduction
Dan received a bachelor’s degree with Honors in 1991 and his J.D. with distinction from the University of Iowa in 1994. After graduating from law school, he served in the U.S. Army Judge Advocate General’s Corps (JAG) in Fort Hood, Texas. He served as a prosecutor and defense counsel in numerous administrative hearings and courts-martial ranging from minor offenses to kidnapping, rape, and capital murder. After being honorably discharged from the U.S. Army JAG Corps, Dan joined a Texas personal injury law firm. Dan worked as the Chief of its Litigation Department and was the firm’s principle trial lawyer for years, trying numerous cases each year. Also, as the head of the firm’s personal injury division, Dan supervised and mentored between 15 and 20 trial lawyers at a time as they prosecuted thousands of cases.
Dan is Board Certified in Personal Injury Trial Law by the Texas Board of Legal Specialization, as well as Board Certified in Civil Trial Law by the National Board of Trial Advocacy. He is an Associate Member of the American Board of Trial Advocates and a Graduate of Gerry Spence’s Trial Lawyer College. He has been recognized by Texas Monthly as a “SuperLawyer.” Dan is listed in Best Lawyers in America and as National Trial Lawyers Association’s Top 100 Trial Lawyers. Besides representing injured Texans, Dan has contributed substantial time to writing articles for local and national publications, speaking to groups on various legal tops, and serving as an Adjunct Professor at the University of Texas School of Law.
QUESTIONNAIRE
We had a client, call her Paula, who was riding with her husband one day and he rear-ended an 18-wheeler that was broken down, stopped on the highway. The trucking company blamed him for not stopping. Paula was severely injured in the collision, partly because her airbags did not go off and her seat broke. So, after we made sure she got the medical care she needed, we sued the trucking company and the manufacturer of her vehicle. After successful settlements with both defendants totaling over seven figures, Paula is now able to return to her life. While we can't do anything about what happened or take away the pain she felt or will feel in the future, we were able to prevent this event from leaving her and her family in financial ruin and give them the opportunity to still have the future they dreamed of.
How did you build a successful practice?Years of fighting hard for my clients. To get full justice, it sometimes takes going to the courthouse. So many lawyers nowadays are unwilling to do that for their clients. These settlement lawyers just take the best offer the insurance company will give and move on to the next case. Because the insurance companies know that is not how we operate, we get better settlement offers and have happier clients. Happy clients is what makes a successful practice.
What should clients look for in a lawyer?Three things: Is the lawyer professional, personal, and does he have the ability to pay? "Professional" means is he experienced enough to get the job done right. "Personal" means does he treat his clients like family, or is it one of these large case mills that we see on TV that have so many clients everyone is treated like a number. "Ability to pay" refers to the size and financial strength of the firm. Does the firm have the personnel and financial depth to take on any defendant, regardless of size.
How important is local knowledge to the success of your cases? It can be very important. I have been practicing in Austin for 20 years and have the local contacts necessary to get things done. Investigating cases and coordinating with the Austin police or other agencies, getting medical care from top flight, local physicians, or knowing who the best experts are locally is all important to achieving the best results. Less experienced attorneys or out-of-town attorneys are not going to have that advantage.
What information can you provide in a free phone consultation? We are able to conduct the entire initial consultation over the phone if that is necessary, such as when a client is remote or in another state. We prefer, however, to meet our clients in person and we can do that 24/7 any day of the year in our office or wherever the client is.
What information do you need in a free phone consultation? We will just get the basic facts of the case so that we are able to determine whether we can help the person or not. When we meet the client in person, we ask that they bring whatever documents or photos they have so that we can begin working for them immediately.
What differentiates you from other lawyers in your community? Our experience and our customer service. The attorneys in our firm have a combined 50 years of practice. All of the attorneys are board certified in personal injury trial law and have tried numerous cases to verdict. We treat every client as if they were family. We answer the phone 24/7 and make ourselves available to potential clients anywhere, any time.
What is the most rewarding aspect of your job?Being able to obtain justice for those who are hurt and in need. People who are hurt just want to be treated with respect and have the wrong that was done to them made right. But, so often, the negligence corporations or insurance companies who represent negligent entities and individuals refuse to do what is right. They take extreme measures to try to avoid being accountable for what they have done. I get the most satisfaction making sure those corporations and insurance companies pay what is fair.
What are your other interests in addition to law?I have a wife and three children which is where I choose to spend my free time.
Are you involved in your community?Yes, the firm and I sponsor local schools, charities, legal foundations and athletic teams in the community.
