Professional Liability Insurance: Yes Discipline Date: 02/14/2011 Discipline Activity: Disbarment Discipline Detail: Bar No. 012317File No. 10-1792 By judgment and order of the presiding disciplinary judge dated February 14, 2011, Donna Platt, 125 East Coronado Road, Phoenix, was disbarred. Ms. Platt was also ordered to pay 8,952.12 plus interest in restitution to her former client. In a previous discipline case, Ms. Platt was suspended and ordered to pay restitution to her former client. Ms. Platt failed to comply with that disciplinary order by not paying the full amount of restitution owed, which led to the present disciplinary case. Ms. Platt¡¯s conduct violated ERs 3.4(c) and 8.4(d), Rule 42, Ariz. R. Sup. Ct., and Rule 53(c), Ariz. R. Sup. Ct.";'>Case: 10-1792, Charges: 1 08/20/10 Suspension - long term Bar No. 012317File Nos. 09-1182; 09-1202Supreme Court No. SB-10-0084-D By Arizona Supreme Court judgment and order dated August 20, 2010, Donna Platt, 125 E. Coronado Rd., Phoenix, AZ, was suspended for six months and one day, effective the date of the judgment and order. Ms. Platt also will be placed on probation if reinstated; was ordered to pay restitution to two clients; and was ordered to pay the costs and expenses of the disciplinary proceedings. In the first matter, a client retained Ms. Platt to represent the client in a medical malpractice claim for injuries sustained in California. Ms. Platt associated California counsel and prosecuted the case with him. They settled the clients claim in or about August 2006. Ms. Platt and the California attorney paid themselves their attorneys fees and disbursed part of the clients share to her, retaining ,962.76 to pay a Medicare lien. In September 2006, they disbursed an additional ,310.91 to the client after they discovered an error in the Medicare lien amount. Ms. Platt advised the client she would work to reduce the Medicare lien on a hardship basis. In March 2008, Medicare offered to reduce the lien amount to ,250.46, if it was paid by April 2008. Ms. Platt did not pay the lien. The client wrote numerous letters to Ms. Platt asking her to get the matter resolved. In August 2008, the client advised Ms. Platt that she couldnt receive medical care and get a new brace because the lien was not resolved. Ms. Platt did not resolve the lien, nor did she respond to many of the clients letters, the bar charge or the State Bars subsequent letters and emails. In the second matter, Ms. Platt represented a client in two separate matters, a personal-injury case and a malpractice case. The personal-injury case was settled in April 2008, with Ms. Platt paying herself her attorney¡¯s fees and costs and paying the client a share of the proceeds. She reserved approximately ,400 to pay outstanding liens. The liens were resolved by October 2008 and the client requested that Ms. Platt pay him the balance. Ms. Platt advised the client she may need the funds for his malpractice case, but the client specifically told Ms. Platt not to use the funds for that purpose. The client wrote to and visited Ms. Platt at her office several times demanding return of the funds. Ms. Platt refused to release the funds and told the client they had unresolved issues concerning the costs Ms. Platt advanced on the malpractice case and also she needed to cover herself from liability for a ,441 sanction imposed in the malpractice case. In the malpractice case, Ms. Platt failed to timely respond to several motions for summary judgment and asked for numerous continuances. Ms. Platt¡¯s responses" the motions were ultimately struck and the court granted the motions for summary judgment against her client. The opposing parties made a settlement offer which the client told Ms. Platt to accept. The client told Ms. Platt on several occasions he wanted to take advantage of the opposition¡¯s offer to settle by giving him a release if he would not appeal. Eventually the client worked directly with opposing counsel"o settle the matter. Ms. Platt did not refund the remaining balance from the PI case to the client.
