We recently were successful in getting a 2nd mortgage to completely release their lien for a client that had filed Chapter 7 bankruptcy in San Diego. Mortgages, such as 2nd mortgages, always retain their lien even if the underlying debt is discharged in bankruptcy. This means you must continue to pay the mortgage in full for the lien to go away. In this case, our client saved a substantial amount of money by not having to pay the mortgage, instantly doubling her equity.
