Cases
Ms. Fard has also successfully appealed unjust results in lower courts in labor and employment matters. Most recently in November 2013 and for the first time in the Fourth District Division Court of Appeal, Division Three ruled that the PAGA representative action was not subject to arbitration and was not to be litigated as an individual claim. See Lauren Whalley and Marysol Rosales v. The Wet Seal, Inc. et al. Case No. G047406. Wet Seal's petition for review was denied. This same issue has been pending before the California Supreme Court in the case of Iskanian v. CLS Transportation Los Angeles, LLC. Ms. Fard has litigated cases against Wet Seal for over seven years. Some of Ms. Fard's efforts in seeking justice for employees of Wet Seal who are primarily young females resulted in a class action law suit which was filed for race discrimination on behalf of African American employees. This case resulted in a settlement of $7.5 million dollars and other terms which will force Wet Seal to comply with California and Federal anti-discrimination laws.
