For me, being the principal of a law firm which has a mission to help the less fortunate is a dream come true. I came to the United States from Poland. My background in canon and civil law from Europe complemented the additional law studies I obtained here in the United States. This background allows me to serve my clients with knowledge and compassion and understand the pain they endure as a result of their accidents.
The most rewarding part of my job, hands down, is being able to work for the people, and not the insurance/corporate system. It is not easy to deal with the uncertainty of a catastrophic injury. Your whole life is turned upside down. To be able to right that ship for victims and injured people is a realization of my own journey, and I impart that piece of me into every case we take.
What Do You Like Least?
As rewarding as it is to help injured people get the justice they deserve, the tragedy can wear on you. People come to me because I can help them when things look the bleakest. That means I see a lot of suffering every day. I know that most people think that lawyers are robots and have a difficult time connecting with their clients.
The fact is, while sometimes we must put aside our feelings to do our job well, we carry that suffering and sorrow with us. If you don’t, then you shouldn’t be in this practice. I have always believed we, as lawyers, must truly know what our client is going through if we want to get them fully compensated. Does that make things more difficult sometimes? Of course, but there is no better way to represent a suffering human being.
How Would You Describe Your Approach To A Case?
In a word? Fearless. Make no mistake about it. When you are injured on a construction site or anywhere else for that matter, the other side is going to try to scare you. They will have an investigator follow you, ask endless questions, and try to delay your lawsuit. All of this can leave a client concerned and scared for their future and the result of their case.
I make it clear that The Platta Law Firm and our clients will not be intimidated. We are relentless in our advocacy. These corporations like to try to intimidate you with their size and money. Well the fact is that we have been beating them for years and we have no plans to stop now. If you hurt someone, you need to pay for it, and we work tirelessly until that happens.
QUESTIONNAIRE
A 44 year old plumber was injured while renovating a mixed use building on Central Park South in Manhattan. As he was attempting to repair a leaking pipe, he slipped on plastic sheeting that was being used to temporarily protect a staircase leading to the subway station below the building. He suffered injuries requiring surgery to his lumbar spine, and his right shoulder and ankle as well as injuries to his neck, head and both wrists. The defendant building owner and general contractor tried to argue the accident was the Plaintiff’s fault and that his injuries preexisted his accident. Their arguments were unsuccessful. The case settled for $3,250,000.
How did you build a successful practice?To start successfully, you first have to recognize the core of your practice. I was fortunate to have a small group of people committed to serving our clients and attorneys who fought tooth and nail when our resources were still limited. Today, we are bigger and stronger, but never forgot where we came from.
What should clients look for in a lawyer?It should not surprise you to learn that the best workplace accident lawyers are found in New York City. However, that doesn’t mean that each law firm handles a case equally well. First, an attorney must be able to properly speak to the jury, if your case goes to trial. That means speaking in terms that are easily understandable. They must describe the severity of your injuries as well as the pain and limitations that your injuries cause. If your attorney does not understand the intricacies of medicine, he or she can not apply them to the law. These, among other things, are basic skills that your lawyer must have.
How important is local knowledge to the success of your cases?New York City has one of the strongest labor and personal injury laws in the country. That doesn’t go without saying that our court system comes with a load of complexities. An attorney from any other state would have a hard time adapting their knowledge to what is required in front of a New York judge. That is why local knowledge is absolutely essential for any New York law firm.
What information can you provide in a free phone consultation?During your free consultation, we will ask you detailed questions about the circumstances surrounding your accident. The attorney will ask you questions to determine how the accident happened, who witnessed the accident, and how the accident was reported. We will also want to know about your injuries, treatment, and your earning history to better estimate the value of your case.
What differentiates you from other lawyers in your community?When deciding on a personal injury law firm, you won’t find many that have changed the course of the law in New York for construction workers. The Platta Law Firm, PLLC did just that. In 2011, our firm litigated a case called Wilinski v. 334 E. 92nd Hous. Dev. Fund. Corp., before the state’s highest court, which resulted in a significant change in the law and added further protections to workers. This case also involved a worker who was injured by a falling object, specifically a falling pipe. Our commitment in the Wilinski case not only helped our client, but marked a major victory for construction workers all over the state. Because of the expansion of the law we achieved in Wilinski, construction workers who in the past would have been denied compensation for their injuries are now able to get the money they need to pay their medical bills and support their families. We bring this same kind of commitment and expertise to all of our cases. While we have changed the law concerning falling pipes and other falling objects, we represent all kinds of injured people. Our personal injury law firm dedicates itself to construction accidents (Labor Law), motor vehicle accidents, premises accidents, and workers’ compensation claims.

What are your other interests in addition to law?I love the water. I think it helps fulfill my sense of adventure. Whether it is kite surfing, jet skiing or scuba diving, I love being in the water and getting to explore that world.
Are you involved in your community?Yes, I was the 2017 Grand Marshall for the Polish-American Pulaski Parade and support all community efforts, in and around me. From donating to church funds, or helping a local school get on their feet, our law firm is always there. We also sponsor many community events and festivals, from concerts to sports tournaments.
